Appeal to Elgin Middlesex Soccer Association (EMSA)

You have the right to appeal the decision of your Club, League, or a discipline hearing panel with league jurisdiction.

Any party affected by the decision may appeal to the Elgin Middlesex Soccer Association (EMSA).

How to Submit an Appeal

Your letter of appeal must:

• Clearly state your rationale for appealing the Club/League decision.
• Include a copy of the original written decision.
• Specify your grounds for appeal.
• Be accompanied by the $400 appeal fee, payable by e-transfer to admin@emsadistrict.com.

Failure to provide an adequate rationale will result in your appeal being ruled out of order and disallowed.

Grounds for Appeal

Appeals to EMSA may only be considered on the following grounds:

1. The decision made is beyond the authority and jurisdiction of the decision maker as set out in applicable governing documents.
2. New facts now available that were not in existence or could not have been discovered by due diligence when the decision was made.
3. The decision maker failed to properly interpret the relevant Published Rules.
4. The decision maker failed to follow procedures as described in the relevant Published Rules.
5. The decision was influenced by bias, where bias is defined as a lack of neutrality to such an extent that the decision-maker is unable to consider other views; or
6. The decision is excessive of the guidelines established related to fines, fee, penalties or bonds. 

Appeal Fee and Refund Policy

• The $400 appeal fee must be received before your appeal will be reviewed.
• If your appeal is successful, the full $400 fee will be refunded.
• If the disposition manager determines that no grounds for appeal exist, the $400 fee will be returned less a $50 administration fee.
• If your appeal is heard and unsuccessful, the full appeal fee is forfeited.

Appeal Deadline

Appeals must be submitted to EMSA at discipline@emsadistrict.com within fourteen (14) days of receiving the written decision from the Club, League, or Panel.

Appeal to Ontario Soccer

You have the right to appeal the decision of the Elgin Middlesex Soccer Association (EMSA).

You may submit the Ontario Soccer Appeal Application Form with the applicable fee ($750) to appealscasemanager@ontariosoccer.net

Ontario Soccer has now launched an online portal for appeal. The are platform provides a secure and efficient way for appellants to complete and submit appeal documentation electronically.
